The Rules for the Administration of Employment of Aliens in China provide that "the Employer shall report to the relevant administrative authority for labor and public security, surrender the Work Permit and Residence Permit and complete the exit procedures at the relevant authority for public security on a timely basis should the employment contract of any alien employed by it is terminated." .
The Employer shall, if any alien who holds a valid Work Permit for Aliens and the employment with his/her employer is terminate for any reason, report to the authority for labor and social security that issued the Work Permit for Aliens together with a written certificate within 3 working days from the date of the termination of such employment. The Employer shall send a designated person and the alien as aforesaid together with the relevant written certificate and the Work Permit for Aliens for cancellation thereof.
