Policies and Process for Overseas Organization and Individual to Purchase House in Chongqing
 
I. Policies for Overseas Organization and Individual to Purchase House in Chongqing
According to Method of House Registration (Ministry of Housing and Urban-Rural Development, Directive No. 168) and Opinions on Regulating the Access of Foreign Capital into the Real Estate Market (JZF [2006] No. 171) issued jointly by Ministry of Housing and Urban-Rural Development, Ministry of Commerce, National Development and Reform Commission, the People’s Bank of China, State Administration for Industry & Commerce and State Administration of Foreign Exchange, policies of Chongqing for overseas organization and individual to purchase house in Chongqing are formulated as follows:
(I) Polices for branch and representative office of overseas organization to purchase commodity house in Chongqing for their own utilization
Branches and representative offices (excluding real estate enterprises approved) of overseas organizations in Chongqing may purchase commodity houses meeting actual requirements for their own utilization but are not allowed to purchase commodity houses for others' utilization. Overseas organizations without branches and representative offices are not allowed to purchase commodity houses.
Branches and representative offices of overseas organization shall submit application and registration material according to stipulations of Rules of Chongqing Municipality on Management of Real Estate Transactions and Rules of Chongqing on Registration of Land and Housing Titles and provide statement of no commodity house purchased for their own utilization in Chongqing when they purchase commodity house for their own utilization and apply for registration of house title to land and housing title registration authority (registration authority). In addition, branches shall provide Business License and representative offices shall provide Registration Certificate of Foreign (Regional) Resident Representative Office. If the overseas organization can’t sign contract and apply for registration of house title by its own and entrust others as agent, Power of Attorney shall be notarized or certified.
(II) Polices for overseas individual to purchase commodity house in Chongqing for their own utilization
Overseas individual may purchase commodity house for his/her own utilization if his/her Residence Permit (issued by Exit-Entry Administration Division of Chongqing Public Security Bureau) records an accumulative period over year. Overseas individuals are not allowed to purchase commodity house if his/her accumulative period is not more than one year.
Overseas individuals shall submit application and registration material according to stipulations of Rules of Chongqing Municipality on Management of Real Estate Transactions and Rules of Chongqing on Registration of Land and Housing Titles and provide statement of no commodity house purchased for their own utilization in Chongqing and passport with records of “Residence Permit” when they purchase commodity house for their own utilization and apply for registration of house title to registration authority. If overseas individual provides original identity certification in foreign language, he/she shall apply to organization with foreign translation quality to translate his/her name into Chinese. If the overseas individual can’t sign contract and apply for registration of house title personally and entrust others as agent, Power of Attorney shall be notarized or certified.
(III) Polices for Hong Kong, Macao and Taiwan residents and overseas Chinese to purchase commodity house in Chongqing for their own utilization
Hong Kong, Macao and Taiwan residents and overseas Chinese may purchase houses in Chongqing for their living requirement.
>Hong Kong, Macao and Taiwan residents and overseas Chinese shall submit application and registration material according to stipulations of Rules of Chongqing Municipality on Management of Real Estate Transactions and Rules of Chongqing on Registration of Land and Housing Titles and provide statement of no commodity house purchased for their own utilization in Chongqing when they purchase commodity house for their own utilization and apply for registration of house title to registration authority. If Hong Kong, Macao and Taiwan residents and overseas Chinese can’t sign contract and apply for registration of house title personally and entrust others as agent, Power of Attorney shall be notarized or certified.
(IV) If that overseas organization and individual, Hong Kong, Macao and Taiwan residents purchase commodity house in Chongqing is related to management work of state security issues, it shall be subject to stipulations of Notice of Chongqing Municipal Bureau of State Security and Chongqing Administration of Land, Resource and Housing on House Transfer Relating to Management Work of State Security Issues (YGAF [2010] No. 22)
II. Process for Overseas Organization and Individual to Purchase House in Chongqing
(I) Prior to purchase, check whether the seller has obtained Pre-sale Permit for Commodity House and Property Ownership Certificate
Buyer shall check whether seller has obtained Pre-sale Permit for Commodity House prior to purchase of houses under construction and Property Ownership Certificate prior to purchase of existing houses. Buyer is advised not to sign Purchase Contract of Commodity House and not to pay for the house if Pre-sale Permit for Commodity House and Property Ownership Certificate are not obtained.
Seller may view the Pre-sale Permit for Commodity House and Property Ownership Certificate on Certificate Bulletin Board or through the registration authority.
(II) Prior to signing a purchase contract, check whether the house has been limited for sale such as being sold, mortgage or seizure
Buyer is advised not to sign immediately Purchase Contract of Commodity House with the seller and not to pay immediately for the house though Pre-sale Permit for Commodity House and Property Ownership Certificate are obtained. To protect legal interests, buyer shall check the specific condition of the house and know whether the house is limited for sale such as mortgage, seizure or being sold.
Buyer may check whether the house is limited for sale in registration authority, on www.cq315house.com, or in search system with computer placed at sales site.
(III) Sign contract for commodity house on network, go through contract registration and filing or apply for Property Ownership Certificate in a timely manner
After the above said procedures, buyer may sign the purchase contract with the seller. When purchasing a house under construction, buyer shall ask the seller to sign the contract of commodity house on network and require the seller to go through contract registration and filing within 10 days upon signature; when purchasing an existing house, buyer and seller shall go through procedures of application of Property Ownership Certificate to the registration authority within 30 days upon contract signature.
Buyer may check whether the house contract is registered and filed and the situation of Property Ownership Certificate in registration authority, on www.cq315house.com, or in search system with computer placed at sales site.
